This Agreement applies to the DocSleuth app obtained from the Microsoft Store or any other channel; it does not apply to the app obtained from the Mac App Store (section 1). Please read it before installing or using the app. If you do not agree, do not install or use the app.
1. Scope and parties
- If you obtained the App from the Mac App Store, Apple’s standard Licensed Application End User License Agreement applies and this Agreement does not. This Agreement applies to the App obtained from the Microsoft Store or any other channel. The Terms of Use apply to the App whatever the channel.
- This Agreement is between JinsongTech (진송테크, “we”) and the individual or organisation that installs or uses the DocSleuth app (“you”, and the “App”).
- The App is licensed, not sold. All rights not expressly granted in this Agreement are reserved by us or the respective right holders.
- This Agreement applies together with the Terms of Use and the Privacy Policy. If this Agreement and the Terms of Use conflict, this Agreement prevails as to the licence of the App, but the consumer-protection provisions of the Terms of Use required by law continue to apply.
2. Licence grant
- Subject to this Agreement and the usage rules of the Store from which you obtained the App, we grant you a non-exclusive, non-transferable, non-sublicensable licence to install and use the App on devices you own or control, for personal use or for the internal business purposes of your organisation.
- The number of devices and features such as family sharing follow the relevant Store’s usage rules.
- If any part of the App’s source code is published under a separate licence, that licence governs the source code. This Agreement governs the App as distributed through the channels to which it applies under section 1.1.
3. Restrictions
Except as permitted by this Agreement or by law, you may not:
- copy, modify, translate or create derivative works of the App;
- reverse engineer, decompile or disassemble the App, except to the extent expressly permitted by applicable law (such as Article 101-4 of the Korean Copyright Act);
- rent, lease, resell, redistribute or provide the App to third parties as a service;
- circumvent or disable technical measures such as usage-limit, purchase or integrity checks;
- remove or alter copyright, trademark or other notices in the App; or
- use the App to break the law or infringe others’ rights.
4. Free tier and Pro
- The Free tier provides the App’s features within limits of 5,000 indexed files and 100 OCR pages per month.
- Pro is planned to be offered by Store in-app purchase and removes the Free-tier limits. Paid sales have not started; when they do, price and conditions will be shown on the Store purchase screen before you buy.
- A Pro entitlement belongs to the Store account used to buy it and can be re-applied with the restore-purchase function using the same account.
- Refunds follow our Refund Policy and the relevant Store’s policies.
5. Third-party components and models
- The App includes open-source software that is subject to its own licences, listed in the Open-Source Notices. Nothing in this Agreement limits rights granted to you by those licences.
- The EmbeddingGemma 2 model used for semantic search is subject to the Apache License 2.0 and Google’s Gemma Prohibited Use Policy (ai.google.dev/gemma/prohibited_use_policy). You must not use the App’s features that rely on this model for any purpose prohibited by that policy.
- Models or external embedding services you add yourself are subject to their providers’ licences and terms, which you are responsible for complying with.
6. Updates
We may provide updates through the Stores. Updates are governed by this Agreement unless they come with separate terms. Certain features may change or be restricted where needed for security or legal compliance.
7. Data and external connections
- The App processes your documents on your device and does not send document contents or queries to us.
- The App may connect to Hugging Face servers to download semantic-search model files. If you register an external embedding API and approve it in an operating-system dialog, text excerpts and queries are sent to the server you specified.
- See the Privacy Policy for details.
8. Warranty
- We make reasonable efforts to ensure the App provides the features described on the website and Store product pages.
- To the extent permitted by law, we do not warrant that the App is fit for your particular purpose, will be error-free or uninterrupted, will extract all content from every document, or that OCR results will be accurate.
- TO THE EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS”, AND WE DISCLAIM ALL WARRANTIES NOT EXPRESSLY STATED IN THIS AGREEMENT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
- This section does not limit rights you have under consumer-protection laws, including the Korean Framework Act on Consumers and the Korean Act on Consumer Protection in Electronic Commerce. Mandatory consumer protections under the law of your country of residence are not affected.
9. Limitation of liability
- We compensate loss caused to you by our intent or negligence in accordance with applicable law.
- We are not liable for data loss or damage not attributable to us, such as failure to back up, device failure, or processing by an external server you specified.
- For loss caused by our ordinary negligence, special damages that could not normally have been foreseen are compensated only if we knew or could have known of the circumstances.
- These limitations do not apply to loss caused by our intent or gross negligence, to death or personal injury, or to any liability that cannot be limited by law.
10. Termination
- You may end this Agreement at any time by deleting the App.
- If you materially breach this Agreement and fail to cure the breach within a reasonable period after our request, we may terminate your licence; we may terminate immediately where a cure is impossible, for example where the breach is unlawful.
- On termination you must stop using and delete the App. Refunds on termination follow applicable law and our Refund Policy.
11. Export control
You must use the App in compliance with the export-control laws and sanctions of the Republic of Korea and any other country that applies to your use.
12. Governing law and jurisdiction
- This Agreement is governed by the laws of the Republic of Korea, without prejudice to mandatory consumer protections of the law of your country of residence.
- A suit concerning a transaction subject to the Korean Act on Consumer Protection in Electronic Commerce falls under the exclusive jurisdiction of the district court for your domicile at the time of filing or, if you have no domicile, your residence (Article 36 of that Act). Where neither your domicile nor your residence is clear at the time of filing, and for any other lawsuit, the competent court is determined under the Korean Civil Procedure Act.
13. Additional terms for apps obtained from the Microsoft Store
- If you obtained the App from the Microsoft Store, this Agreement is between you and JinsongTech only; Microsoft Corporation (“Microsoft”) is not a party to this Agreement.
- Microsoft has no responsibility for maintenance or support of the App. JinsongTech is responsible for maintenance, support, warranties and claims relating to the App.
- Downloading, installing on devices and in-app purchases are also subject to the Microsoft Store terms of use and terms of sale.
